Terms and Conditions

Just Travel Ltd, is a company registered in England and Wales under company number 15258937. The company’s registered address is 167-169 Great Portland Street, 5 th Floor, London, United Kingdom, W1W 5PF (“we” or “us”).


We are a supplier of holiday services, and your booking is with Just Travel Ltd or one of its agents.


These terms and conditions are your contract with us for provision of any Holiday Services you book with us.


In this document, “you”  and “your” include the lead-named person on the confirmation invoice and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.


We use the terms 'booking' or 'holiday' to refer to your holiday. We operate in the following capacities:

1. As an agent acting on behalf of the supplier of your holiday or a part of it (e.g., a tour operator, airline, or hotel). In this capacity, we arrange that part (or separate parts) of your holiday with the supplier(s), and the fees are charged separately. The contract(s) for the supply of those parts is directly between the supplier(s) and you. These elements of your holiday are referred to as agency bookings.

2. As the organiser of package holidays, where we arrange and provide holidays by combining two or more significant components, such as flights, accommodation, or another substantial part of the holiday. These package travel holidays have a duration of over 24 hours or involve an overnight stay, and we charge a single all-inclusive fee. The contract for the delivery of your holiday is between you and us in this case.


Our obligations to you may vary depending on the type of holiday you book and whether it is an agency or a package travel booking.


These booking conditions comprise section A All Bookings, section B Agency Bookings, and section C Package Travel Bookings. These terms, along with our privacy policy (see privacy policy) and website terms of use (see www.justravelgroup.co.uk), and any other written information brought to your attention before confirming your booking, apply to your booking.


Please carefully read these documents as they outline our and your respective rights and obligations regarding your booking. By making a booking through us, you are legally bound by the terms set out in these documents. If any part is unclear, please inform us.


SECTION A – ALL BOOKINGS


1. Protected Trust Services

Just Travel Ltd, is a proud member of Protected Trust Services (PTS). Our membership number is 6111. Our partnership with PTS, symbolises our dedication to not only providing exceptional service but also ensuring comprehensive financial and consumer protection for you, our valued clients. When you book with us, rest assured that your financial transactions are meticulously safeguarded. Payments are securely directed to the PTS Trust, introducing an additional layer of security. At Just Travel Ltd, payment is only received after settling all suppliers, and your holiday has commenced, with limited exceptions for immediate payment credit card bookings.


This rigorous process is strategically designed to safeguard your money against potential supplier failures or unforeseen circumstances involving our travel company. 2. Booking

By making a booking, you agree on behalf of all persons detailed on the booking that you have read these terms and conditions and agree to be bound by them; you consent to our use of information in accordance with our Privacy Policy and that you are over 18 years of age.


You guarantee that you have the authority to accept the terms of these booking conditions, and do accept on behalf of your party/


A booking will exist as soon as your agent issues you with our confirmation invoice. Online bookings will receive a booking confirmation via email.


As we work with live systems, we can accept no liability if sometimes a holiday is sold out by the time we receive your enquiry or booking instructions.


When you make your booking you must pay the relevant deposit as specified at the time of booking. If you believe that any details on the confirmation receipt (or any other document) are wrong you must advise us immediately as changes cannot be made later and it may harm your rights if we are not notified of any inaccuracies in any document immediately.


All deposits are non-refundable.


Please check that all names, dates, and timings are correct on receipt of all documents and advise us of any errors immediately. Any changes to these details may incur charges. Please ensure that the names given match the relevant passport.


3. Insurance

It is a condition of your contract that you obtain and maintain adequate travel insurance. It is your responsibility to arrange appropriate travel insurance. We strongly suggest that you take out suitable insurance cover at the time of confirming your booking. You must take out a policy of insurance in order to cover you and your party against the cost of cancellation by you; the cost of assistance (including repatriation) in the event of accident or illness; loss of baggage and money; and other expenses. If you fail to travel with adequate insurance cover we will not be liable for any losses in respect of which insurance cover would otherwise have been available.


4. Payment

You will be required to pay the relevant deposit of the tour operator you are booking with or make full payment if your booking is made within 12 weeks of departure (14 weeks for cruise) at the time of booking. Where you only pay a deposit you must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we will notify the supplier who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions. Where you have booked a package, you will be subject to our cancellation charges. See section C Package Travel Bookings.


5. Low Deposits

Some tour operators offer Low Deposit Schemes. This is where you pay a lower deposit at time of booking and agree to pay the remainder of the deposit at a later specified date. If this is available to you and you take advantage of this offer you are liable to pay the remainder of the deposit by the date specified. This applies even if you cancel your booking. If you fail to pay the remainder of the deposit we will notify the supplier who may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.


6. 0% Deposits

Some tour operators offer 0% deposits. This is on condition that you agree to set up a direct debit to make monthly payments for a specified amount and time. If payment is not maintained as per the agreement the tour operator may cancel your booking and charge the cancellation fees set out in their Terms and Conditions.


7. Accuracy

We endeavour to ensure that all the information and prices both on our website, in our brochures and on social media are accurate, however occasionally changes and errors occur, and we reserve the right to correct prices and other details in such circumstances. You must check with us the current price and all other details relating to the booking you wish to make before your booking is confirmed. When you ask us to make a booking, that shall constitute an offer to us, which we may accept or decline as we determine in our sole discretion.


8. Special Requests

If you have any special requests (for example dietary requirements, cots, or room location), please let us know at the time of booking. We will pass on all such requests to the supplier, but we cannot guarantee that they will be met, and we will have no liability to you if they are not.


9. Special Assistance

We are committed to accommodating any specific requirements you may have to the best of our ability. If you or any member of your party has a medical condition or disability that could impact your stay, we are able to make enquiries to the supplier about the suitability of arrangements for you and provide replies prior to booking. You must make all requests in advance before a booking is confirmed. Some holidays may not be suitable for clients with reduced mobility or special needs. Airlines and transport companies may require specific details of a health, disability, or mobility issue prior to travel.


10. Seat Requests

Where possible, Just Travel will pass on any seat requests to the relevant airline. However, we must stress that seating requests cannot be guaranteed, and we cannot be held responsible for requested seating being unavailable at the time of check-in. Many airlines have introduced charges to pre-book seats; information and guidance can be found on the relevant airline’s website.


11. Special Meals

For travellers with special dietary requirements, special meals can normally be requested and must be done so, well in advance of the travel date. Just Travel accept no liability for any requested special meals not being available.


12. Baggage Allowance

Baggage allowance will be shown on your flight tickets – should this be exceeded you may be charged excess baggage charges at check-in. Please note: Baggage allowance for domestic/internal/ seaplane flights may be less than your international allowance.


13. Frequent Flyer Schemes

Not all airline tickets sold by Just Travel are eligible for mileage/points accrual. We strongly advise that you check with the airline(s) concerned regarding the use of frequent flyer membership(s) with your booking.


14. Direct/Codeshare Flights

Direct flights showing one flight number may require a change of aircraft or touchdown en-route. Some flight routings to the USA may also require customs and immigration clearance at the first arrival airport. Due to an increasing number of global airline alliances, ‘codeshare’ flights, where one airline operates a service on behalf of another, are commonplace. Your printed itinerary will confirm details of such flights.


15. Sporting Equipment

Most Airlines charge for the carriage of sports equipment (this includes golf clubs, scuba diving, surfboards, windsurf and bikes). This equipment is not included as part of your baggage allowance. Charges may be payable either at the time of booking, or at the airport prior to departure. If you are planning to take sports equipment, please ask your Travel Agent to contact the relevant airline at the time of booking, and they will be able to provide details of prices. You or your Travel Agent must also give details of your request to take the sporting equipment to us. If sports equipment is not pre-booked, excess baggage charges will apply. Sports equipment must usually be packed separately from other baggage, as these may need to be checked at check-in. Please ensure that all your sporting equipment is insured.


16. All Inclusive holidays

All Inclusive benefits may start and finish at certain times on the dates of arrival and departure. Resorts reserve the right to alter the terms of their All-Inclusive package at short notice and this is something beyond our control.


17. Room Allocation

When you arrive at your accommodation, you will be allocated a room. It is your responsibility to confirm the check-in and check-out times directly with your accommodation supplier. Please note that any local taxes and expenses will be payable to your accommodation supplier in resort on check-out.


18. Check in & Check-out times

In general, check-in times range between 2pm and 4 pm and check-out between 10am and 12 noon. Early check-in is at the discretion of the Hotel and cannot be guaranteed unless you pay for an additional night prior to arrival.


19. Hotel Beds

We cannot guarantee the type of beds provided, only that the room will be large enough to accommodate the number of passengers booked.


20. Hotel Resort Fees and Hotel Charges

Particularly in the USA, many hotels apply resort fees or a government levy. Resort fees cover items such as local newspapers, room safe, use of the gym etc. and can vary from $10 per room per day upwards. Charges are payable locally and are also subject to increase or change at any time. Please ensure your check your final bill upon check-out and raise any queries with the Front Desk staff prior to your departure.


21. Accommodation Ratings and Standards

Accommodation ratings are displayed as provided by the supplier. These are intended to give a guide to the services and facilities you should expect from your accommodation. Standards and ratings may vary between countries, as well as between suppliers. We cannot guarantee the accuracy of any ratings given and no warranty is given or implied.


Safety standards in some countries may differ from those applicable in the United Kingdom. All properties comply with applicable health and safety regulations. We strongly advise that all customers seek to minimise their exposure to injury by familiarising themselves with relevant safety information.


22. Dress code

Hotels, Cruise lines and Rail journeys may observe a dress code, particularly for dining in the evening. Please check the relevant website for the most up to date information.


23. Excursions

Excursions or other tours that you may choose to book whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.


24. Festive bookings

Hotels may charge a supplement for compulsory services such as Gala Dinners over the Christmas & New Year Period. Restaurants can become busy, and it is advisable to check with your hotel to establish if advance bookings are required.


25. Ramadan & other Religious or National Festivals

During Ramadan eating, smoking & drinking in public places can be prohibited. When countries have public holidays or are celebrating local festivals some facilities and activities may be restricted.


26. Smoking

Most Airlines & Hotels operate a complete non-smoking policy. We recommend you contact your Airline / Accommodation regarding current smoking policies.


27. Taxes

We will collect all mandatory taxes from you. However, some countries may charge additional departure, hotel, or other taxes in respect of your travel arrangements that must be paid locally. We advise you to retain sufficient local currency to meet these charges and we will advise you of any such charges at the time of booking.


28. Force Majeure

Except where and to the extent stated otherwise in these terms, we are not responsible for any failure or issue in relation to your booking where this arises as a result of circumstances beyond our control. Such circumstances will usually include, but are not limited to, Act of God, war, threat of war, riots, airport closures, airspace closures (as well as other air traffic management decisions which may give rise to long or overnight delays or cancellations of one or more flights), natural disasters such as floods, earthquakes, volcanic eruption or weather conditions (hurricane, typhoon, lightning) which make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport, , explosion, industrial dispute, terrorist activity and its consequences, natural or nuclear disaster, fire, government action, drone activity, significant risks to human health such as the outbreak of serious disease at the travel destination, epidemics, pandemics (including but not limited to the ongoing effects of COVID-19 and any new strain of the coronavirus), unavoidable technical problems with transport and all similar events outside our or the supplier(s) concerned control and significant building work taking place outside of your accommodation (such as resort development). Advice from the government to avoid or leave a particular country also constitutes unavoidable circumstances. In such situations we will adhere to the advice given by the Foreign, Commonwealth and Development Office.


29. Weather

Weather conditions around the world are becoming more unpredictable. Just Travel cannot be held liable for adverse weather conditions that may impact on the enjoyment of your holiday.


30. Building Work

We understand that the development and refurbishment of accommodation establishments and resorts can occur unexpectedly and sometimes at a rapid pace. While we may not have control over such projects, as a responsible tour operator/travel agent, it is our priority to keep you informed about any significant building or refurbishment work happening during your stay. While general refurbishments are necessary to maintain standards, we will make every effort to notify you promptly of any such activity, even if it occurs shortly before your departure. Our goal is to ensure transparency and provide you with the necessary information to make informed decisions about your travel plans. However, while every effort will be made, it may not be possible to advise you of emergency repairs prior to your departure from the UK. In some destinations, construction work is commonplace, and Hotels are not liable for any building works taking place out with their property.


31. Passports/Visas/Health/Travel Advice

It is your responsibility to check and fulfil the passport, visa, health, and immigration requirements applicable to your booking. We will only provide general information relating to this area, which shall not be specific to your particular circumstances. You must check requirements for your own specific circumstances in good time prior to commencement of your holiday. PASSPORT and VISA requirements change regularly in many countries. They may have changed since you last travelled so you MUST always check prior to travel. Please continue to monitor Foreign Office Travel Advice as that may also change. Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. For further information you can also contact the Passport Office on 0870 5210410 or visit www.passport.gov.uk


Special conditions apply for travel to the USA, and all passengers must have individual machine-readable passports. Please check www.usembassy.org.uk . You will also need an ESTA. An ESTA (officially known as the Electronic System for Travel Authorisation) is part of the United States Visa Waiver program. It lets you visit the US for a period of 90 days or less without the need for a visa – as long as it is for a holiday or a business trip. An ESTA is open to all citizens of visa waiver countries, including the UK.


You will need one if:

a) You're a UK citizen or a citizen from another visa waiver country visiting the US

b) Your trip is for 90 days or less and is for business or pleasure

c) You don’t already have a visa for visiting the US

d) You’re arriving by plane or cruise ship


Note that you’ll need an ESTA even if you’re only stopping briefly in the US to catch a connecting flight or ship in order to travel elsewhere.


Make sure you check the latest entry requirements well in advance of your trip so you have plenty of time to apply for any travel documents you need.

For European holidays you should obtain a completed and issued form EHIC or UK Global Health Insurance Card (GHIC) prior to departure. EHIC provisions have changed and information on the EHIC is available at

Up to date travel advice can be obtained from the Foreign and Commonwealth Office at www.fco.gov.uk


Non-British passport holders, including other EU nationals, should obtain up to date advice on passport and visa requirements from the Embassy, High Commission or Consulate of your destination or country(ies) through which you are travelling.


We do not accept any responsibility if you cannot travel, or incur any other loss, cost, expense, or suffer any damage, because you have not complied with any passport, visa, immigration requirements or health formalities or because you are restricted from travel.


If we incur any loss, cost, expense, or suffer any damage or claim, you must reimburse us for this, where arising as a result of your failure to comply with any passport, visa, immigration requirements or health formalities or any restriction upon travel to which you are subject.


32. Covid-19

We acknowledge the ongoing Covid-19 global crisis and accept our obligations to comply with any binding requirements of governments and authorities, both in the UK and internationally.


Please note that we will have no liability for any loss, cost, expense, damage, claim, or other liability incurred or suffered by you (including, where applicable, the cost of medical treatment), in the following circumstances:


i. if you, or anyone in your booking party, test positive for Covid-19 and have to quarantine for a period of time prior to or after your departure, or are notified or otherwise become aware that you have, or suspect you may have, come into close contact with someone who has tested positive for Covid-19 (or where they otherwise suspect they may have Covid-19) and have to self-isolate for a period of time prior to or after your departure; or

ii. you fail any tests, checks or other measures imposed by us, a supplier, airline, port or airport, border control authority or other government body or authority or fail to submit for testing or assessment when requested to do so, and as such you are denied entry to board the flight, entry to the destination, access to the services or you are otherwise unable to proceed with the holiday, or that portion of the holiday.


If this happens in the 14-day period prior to your departure date, you must contact us as you may no longer be able to travel. We will offer you the following options where possible and subject to availability:


i. postponing your holiday to a later date. We will notify you of any impact on the booking price the postponement may have (please note that you may have to pay full cancellation charges on some elements of your holiday, such as the flight, as well any increase in the booking price due to the change);

ii. if not everyone on the booking is affected, you will have the right to transfer your place on the holiday to another person nominated by you, subject always to the other parts of these terms;

iii. cancelling your holiday, in which case cancellation charges as referred to in these terms will apply. You may be able to claim these costs back from your travel insurance.


If this happens whilst you are on your holiday, please notify us without delay and we will endeavour to provide assistance. However, we will not be responsible for covering the cost of any curtailment of your holiday, missed transport arrangements, additional accommodation required, or other associated costs incurred by you. You must ensure you have travel insurance which covers these costs for you.


You also acknowledge that the suppliers providing your holiday, including airlines, hotels, and excursion providers, will need to comply with national and/or local requirements relating to Covid-19, and may have implemented certain measures as a result. This will likely include specific requirements regarding personal protective equipment, such as use of face-masks by staff (and you may be required to wear a face- mask as well), social distancing, maximum number restrictions on the use of certain facilities, designated alternative entrance and exit routes, mandatory hand sanitisation, limited entertainment options and limited food/drink availability. We do not expect these measures to have a significant impact on your enjoyment of the holiday and all measures will be taken with the purpose of securing your safety and those around you. You must comply with these arrangements.


33. Drugs & Alcohol

Legislation restricting the carriage of alcohol and drugs (to include prescription medication) is more prevalent in destinations worldwide. Please visit FCO official website for updated information on any laws governing drugs and alcohol.


34. Medication carriage (UAE)

If you are planning to travel with any prescribed or over the counter medicines for personal use, you will need to meet the UAE’s specific requirements for your medicine to be allowed into the country. If you are entering the country with medication that the UAE classes as narcotic, psychotropic, controlled, or semi-controlled, approval is needed from the UAE authorities. Approval should be requested in advance. To gain approval prior to travelling, you can apply for a permit online using the electronic application form on the UAE Ministry of Health website. If you arrive in the UAE without prior approval or the required documentation, the medication will not be allowed into the UAE, and you may be prosecuted under UAE law.


35. Zika Virus

If you are pregnant, or planning to become pregnant, and planning to travel to any of the destinations affected by Zika Virus, you should seek medical advice from your healthcare provider. If it is necessary to change or cancel your holiday arrangements, you should request that your healthcare provider gives you a medical certificate in order to assist you with any possible insurance claim.


36. Travel Delays and Cancellations

In the event that you or any member of your party misses a scheduled flight or other transport arrangement, resulting in its cancellation or a delay exceeding 3 hours, regardless of the cause, it is imperative to promptly contact both us and the relevant transport provider.


We are committed to providing swift assistance, which may include aiding in locating refreshments and accommodation, although we are not liable for covering these expenses. Any transport provider may, at their discretion, offer such provisions directly.


Upon your request, we may assist in arranging alternative travel, although this could entail changes and potentially affect the original booking price.


Unless attributable to our fault, we bear no responsibility for any resulting loss, costs, expenses, damage, or claims. Instances where cancellations or delays are beyond our control, such as due to the actions of third parties not acting on our behalf, are exempt from our liability.


The travel information we furnish, including timings, is based on the data available to us and is subject to alteration by the respective travel service provider. Therefore, this information serves as guidance only and may require confirmation from the provider. While we assume responsibility as your tour operator, we do not represent or bind the airlines mentioned regarding your travel arrangements. Your tickets, dispatched approximately two weeks before departure, will contain the latest travel timings, which you should meticulously review upon receipt. If there are any subsequent changes, we will promptly inform you.


Should the identity of the travel service provider not be evident in your booking confirmation, we will disclose it as soon as it becomes known to us.


Under UK Law, passengers have rights to refunds and/or compensation from airlines under certain circumstances, such as denied boarding, flight cancellations, or delays. Comprehensive details of these rights are available at UK airports and from airlines directly. In the event of non-compliance by the airline, passengers should address their complaints to the Civil Aviation Authority at www.caa.co.uk/passengers. Any reimbursement in such cases is the responsibility of the airline and does not automatically entitle passengers to a refund from us. If passengers opt not to claim directly from the airline and instead seek compensation from us, they must assign to us any rights they possess against the airline regarding the claim.


A flight delay or cancellation does not automatically grant the right to cancel any other arrangements, even if they were made in conjunction with the flight.


37. Our Liability to You

Except as expressly set out in these terms, we will not be liable for any injury, illness, death, loss, damage, expense, cost claim or other liability to the extent it results from:-


i. the negligent act(s) and/or omission(s) of the person(s) affected;

ii. your breach of these terms;

iii. the act(s) and/or omission(s) of a third party who is not acting on our behalf;

iv. circumstances beyond our control or our supplier(s)’ control;

v. matters arising from or connected with the occurrence of a pandemic, epidemic, or the acts (including restrictions) of any governmental or other authority.


Our liability to you is further limited as follows:


i. Loss of and/or damage to any luggage or personal possessions and money - To the maximum amount we will be liable to you in respect shall be an amount equivalent to the excess on your insurance policy applicable to this type of loss.

ii. Claims which do not involve injury, illness, or death - The maximum amount we will have to pay you in respect of these claims is three times the booking price.

iii. Claims in respect of international travel by air, sea and rail, or any stay in a hotel - The extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to hotel arrangements) and applicable laws. In addition, the transport provider’s own limitations of liability in their terms and conditions will also apply to us, as if we were the transport provider

iv. In any circumstances in which a carrier is liable to you by virtue of the Denied Boarding Regulation 261/2004, any liability we may have to you under our contract with you, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) we were a carrier.

v. We are entitled to deduct any payment which you have received or are entitled to receive from any third party from our liability to you. Where we make a payment to you in relation to any liability, if we require you must assign to us (or to such persons as we direct, for example any insurer) your right to seek recovery from any third party in relation to the matter which gave rise to that liability, and provide us (or such person) such reasonable assistance as we (or they) may request in relation to any action taken against such third party.

vi. We are not liable for any service which does not form part of your booking, for example any service you arrange yourself with a third party. Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your contracted arrangements with us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.


38. Your Behaviour

You must take all reasonable steps to look after your personal safety and conduct yourself in an orderly and acceptable manner and not disrupt the enjoyment of, annoy, or cause distress, danger, or risk to, other persons. You must adhere to the rules and regulations at any place you stay or visit, and the terms and conditions and directions of any provider of any service you enjoy (including any transport service). You must not break the law or cause damage to any property or thing. You must not cause delay or disruption to any service (including any transport service). You must ensure that every other person in your party does the same. If in our opinion or in the opinion of provider of any service relevant to your booking, you, or any member of your party breaches any of the foregoing, or appears likely to, we may cancel your booking immediately and/or cease providing services to you and/or your party, without liability to you. You shall not be entitled to any refund of your booking price or any other payment or refund. In the event of such cancellation, you and/or your party must leave your accommodation and you shall have no entitlement to continue to enjoy any service (including any transport service) forming part of your booking. We will have no further obligations to you and/or your party. We shall not be liable to you, and we will not pay any expenses or costs incurred as a result of termination. You shall be liable to us for loss, cost, expense, damage, claims or other liability we incur or are alleged to have incurred as a result of your actions, and you shall reimburse us (or such person as we direct) therefor on demand.


39. Behaviour of Others

We are not liable or responsible for the actions or behaviour of other persons who are not acting at our direction.


40. Excursions

Excursions or other tours that you may choose to book or pay for whilst you are on holiday are not part of your package holiday provided by us. For any excursion or other tour that you book, your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.


41. Complaints

If you have a complaint about any of the services included in your holiday, you must inform your resort representative or the relevant supplier (for examples, your hotelier where the issue is with your accommodation) without undue delay who will endeavour to put things right. If it is not resolved locally, please follow this up as soon as possible after your return home, ideally within 28 days of the end of your holiday by writing to info@justtravelgroup.co.uk giving your booking reference and all other relevant information. Please keep your letter concise and to the point. If you fail to follow the requirement to report your complaint in resort, we will have been deprived of the opportunity to investigate and rectify it and this may affect your rights under this booking.


The potential consequences of making false complaints and claims include being reported to the Police and facing legal proceedings.


42. Delivery of Documents

All documents (e.g. invoices/tickets/Insurance policies) will be sent to you by email or post where applicable. Once documents leave our offices we will not be responsible for their loss unless such loss is due to our negligence. If your travel documents have not been received by you, or you have mislaid your travel documents, you must inform us at least 7 days prior to departure. Failure to do so may result in additional charges payable by

you as special arrangements will have to be made. Tickets once sold towards an Attraction or sporting event cannot be replaced if lost.


43. Failure to Disclose

If you did not give us full details at the time of booking of circumstances which may be relevant to your booking or which may affect the ability of your booking to be properly provided, we may cancel your booking. In such an event, cancellation charges as referred to in these terms may apply.


44. Conditions of Suppliers

Many of the services which make up your holiday are provided by independent suppliers. Those suppliers provide these services in accordance with their own booking conditions. By making a booking with us, you agree to abide by those booking conditions. Copies of such booking conditions are available from us on request.


45. Data Protection and Privacy

Please see our data protection and privacy policy for full information regarding the way in which we use and store your personal data.


46. Law and Jurisdiction

This booking is governed by English Law, and the exclusive jurisdiction of the courts of England and Wales. You may however choose the law and jurisdiction of Scotland or Northern Ireland if you live there and wish to do so in which case you can bring proceedings in your local court under Scottish or Northern Irish law, as applicable.


SECTION B – AGENCY BOOKINGS


In relation to agency bookings, we act only as an agent of the supplier(s) of the booking.


The responsibility for the performance of the booking is with the supplier, not us and we accept no liability in relation to the booking or for the acts or omissions of any supplier(s) or other person(s) or party(ies) connected with the booking. Your booking will be subject to the specific booking conditions of the relevant supplier(s) and you are advised to read them carefully prior to booking. The booking conditions may limit and/or exclude the supplier's liability to you. The booking conditions will be sent to you by us or the supplier during the process of arranging the booking.


1. Your Contract

A contract for a booking is made between you and a supplier at the earlier of when:


a) you tell us that you would like to accept the written or verbal quotation relating to the booking;

b) you pay the deposit or take any other payment towards the booking or

c) a booking confirmation is provided by us or the supplier. If your booking includes a flight, we (or the supplier) will also issue you with an ATOL Certificate.


Please check your booking confirmation and ATOL Certificate carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport. As we act only as an agent, we have no responsibility for any errors in any documentation except where an error is made by us.


You must pay the booking price for an agency booking by the dates set out in the booking confirmation. The booking price may be payable in advance of the booking confirmation being issued. A deposit may be payable. If full payment is not received by the due date, the supplier may cancel your booking and charge you cancellation fees as set out in their booking conditions.


Except where otherwise stated in the booking conditions of the Supplier concerned, all monies you pay to us for travel arrangements will be held on behalf of the Supplier and forwarded on to the Supplier in accordance with our agreement with them.


2. Prices

Please note that changes and errors sometimes occur. You must check the price of your chosen arrangements at the time of booking. We reserve the right to amend advertised prices at any time. We also reserve the right to correct errors in both advertised prices and prices for confirmed bookings.


3. Changes and Cancellations by You

Any cancellation or change request relating to an agency booking must be sent to us in writing, by email, fax, or post. Proof of posting is not proof of receipt; therefore you are advised to also check we have received the request with your agent by telephone. Please ensure that you have received written confirmation of any changes to your booking prior to travel. If you have not the change may not have been made. Whilst we will try to assist, we cannot guarantee that such requests will be met. Changes and cancellations can only be accepted in accordance with the supplier’s booking conditions.


Most travel service suppliers do not allow changes without a charge. Most budget airlines have cancellation charges of 100%.


4. Changes and Cancellations by the Supplier

We will inform you as soon as reasonably possible if the supplier needs to make a change to booking or to cancel it. We will also liaise between you and the supplier in relation to any alternative arrangements offered by the supplier. The supplier’s liability to you in respect of changes and cancellation shall be as set out in their booking conditions. We shall have no liability to you for changes or cancellation made to your arrangements by the supplier under your contract with them.


5. Our responsibility for your Booking

Your contract is with the supplier and their booking conditions apply. As agent, we accept no responsibility for the actual provision of the bookings. Our responsibilities are limited to making the agency booking in accordance with your instructions. We shall not be liable for any information about the booking that we pass on to you in good faith. However, in the event that we are found liable to you on any basis whatsoever, our maximum liability to you is limited to twice the cost of the commission we earn on your booking (of the affected elements of the booking). We do not exclude or limit any liability for death or personal injury that arises as a result of our negligence or that of any of our employees or agents whilst acting in the course of their employment or duties or any liability that cannot be excluded or limited under law.


6. Complaints

The contract for your arrangements is between you and the supplier, any queries or concerns should be addressed to them. If you have a problem whilst on holiday, we recommend that you should report this to the supplier or their local agent (if there is one) immediately. If you fail to follow this procedure there will be less opportunity for the supplier to investigate and rectify your complaint. The amount of compensation you may be entitled to may therefore be reduced or extinguished as a result.


If you wish to complain when you return home, write to the supplier. You will see their name and contact details in the booking confirmation we send you. If you wish to complain about any service we have provided to you or an agent please contact us at info@justtravelgroup.co.uk


52. Financial Protection

Financial protection is provided for agency bookings. This means that you are protected if the supplier ceases trading.


For flights or flight inclusive bookings this will be through the supplier’s Air Travel Organiser’s Licence issued by the Civil Aviation Authority, Aviation House, Beehive Ringroad, Crawley, West Sussex, RH6 0YR, UK, telephone 0330 022 1500, email claims@caa.co.uk


When you buy an ATOL protected flight or flight inclusive holiday you will receive an ATOL Certificate. This lists what is protected, where you can get information on what this means for you, and who to contact if things go wrong.


Your supplier will provide you with the services listed on the ATOL Certificate (or a suitable alternative). Where the supplier has ceased trading, an alternative ATOL holder may provide you with those services or a suitable alternative. Where an alternative ATOL holder provides the services you must pay any money outstanding for those services not to us but to that alternative ATOL holder. In some cases, it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme or via your credit card issuers where applicable.


If the services cannot be provided, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you may be required to assign to those Trustees any claims which you have or may have arising out of or relating to the non- provision of the services, including any claim against any third party (including your credit card issuer, where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.


8. Documentation & Information

All descriptions and content on our website, social media or otherwise issued by us is done so on behalf of the supplier(s) in question are intended to present a general idea of the services provided by the supplier(s) in question. We do not check, and we shall not be liable for, the content of such information. Not all details of relevant services can be included on our website and/or social media, and relevant information may be omitted. All services shown are subject to availability.


SECTION C – PACKAGE TRAVEL BOOKINGS


This section only applies to Tailor-Made Packages booked with us, where we are acting as the Package Organiser. Please read this section in conjunction with Section A of these Booking Terms & Conditions.


Where your booking is for Package travel arrangements that we have organised, as defined below, we will act as a “Package Organiser” and you will receive the rights and benefits under the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTRs”), as outlined in this Section C of our Booking Conditions.


A “Package” exists if you book a combination of at least two different types of the following separate travel

services, for the purpose of the same trip or holiday:


a) transport; or

b) accommodation; or

c) rental of cars, motor vehicles or motorcycles (in certain circumstances); and

d) any other tourist service not intrinsically part of one of the above travel services, provided that those travel services are purchased together from a single visit to us and selected by you before you agree to pay; or are advertised, sold, or charged at an inclusive or total price; or advertised or sold under the term “package” or a similar term.


IMPORTANT NOTE: where you have made a booking which consists of not more than one type of travel service as listed at (a) – (c) above, combined with one or more tourist services as listed at (d) above, this will not create a Package where the tourist services:


  • do not account for 25% of the value of the combination and are not advertised as, and do not otherwise represent, an essential feature of the package; or
  • are selected and purchased after the performance of the transport, accommodation or car rental has started.


These bookings will be treated as “single service” bookings and will not be afforded the benefit of the rights under the PTRs. Please see Section B of these Booking Terms & Conditions for the terms applicable to such arrangements.


Please note: We also sell Packages (‘Ready-Made Packages’) that are not organised by us but by a third-party Supplier, which we sell as an Agent on the Supplier’s behalf. We will advise you where this is the case prior to you placing your booking. For such sales, this Section c will not apply, please refer to Section B instead.


1. When a contract is concluded with us and our general right to cancel

A package travel booking is made with us when:


a) you tell us that you would like to accept our written or verbal quotation;

b) you pay us the deposit we ask for; and

c) we issue you with a booking confirmation.


We may decline to issue a booking confirmation at our absolute discretion. If we do, we will return your deposit. In this instance, no contract is concluded with us for us to provide to you your package travel holiday.


We may cancel your booking at any time prior to it taking place, for example due to unexpected circumstances arising. In such an event, we shall refund to you the booking price then paid to us, but we shall have no additional liability to you.


For all bookings, by making a booking, the first named person on the booking agrees on behalf of all persons detailed on the booking that:


a. they have read these Booking Conditions, our website terms of use (for online bookings) and any other written information we have brought to their attention before the booking was confirmed, and have the authority to and does agree to be bound by them;

b. they have read our privacy policy and consent to our use of information (including personal data)in accordance with it; and

c. they are over 18 years of age, resident in the United Kingdom and, where placing an order for services with age restrictions, declare that they and all members of the party are of the appropriate age to purchase those services.


2. Checking what is sent to you

If your package travel holiday includes flights, we will issue an ATOL Certificate along with the booking confirmation.


Upon receipt, if you believe that any details on the ATOL Certificate or booking confirmation or any other document sent to you are wrong you must advise us immediately, as changes made after ten days of despatch (five days for tickets) will incur additional charges and/or may not be possible (for example due to unavailability of the relevant services).


3. What you have to pay us and when

Your booking confirmation will include details of what you have to pay us and when. If we do not receive payment in full and on time, we may cancel your booking. In this event the cancellation charges set out in clause 5 below will become payable.


4. Changes in prices

Whilst we strive to ensure the information made available by us is correct and up to date at all times, we do not guarantee that we will be able to do this. We may amend the price of holidays at any time before a booking is made.


Where a booking has been made with us and we shall have the right to correct errors in the booking price.


If you ask us to amend your booking, provide additional or attend to different arrangements, your booking price will change.


Certain elements which make up the booking price may be subject to change. The following elements of the booking price may be subject to change:


i. Those which are made up by transportation costs, which may be changed where the cost to us changes.

ii. Those elements which are dependent upon the cost of fuel.

iii. Those elements which are made up by the cost of meeting requirements to allow provision of your holiday, where these have been introduced or changed since the time of your booking, for example requirements to provide certain additional or amended documentation to allow entry into a country.

iv. Those elements which are affected by changes in the charges our supplier’s levy.

v. Changes in related insurance charges.

vi. Dues, taxes, or fees payable to a government or authority including but not limited to tourist taxes, landing taxes or embarkation or disembarkation fees at ports and airports.

vii. Elements the charge for which has been calculated in a currency other than pounds sterling, in which case the final amount payable may be affected by the exchange rates applicable at the time of payment.


We shall have the right to amend the booking price due to any of these causes, and you must pay us the amended booking price, subject to the following. We will absorb, and you will not be charged for, any increase in your booking price of up to 2% in total, except where that increase has arisen due to changes in insurance premiums, or any amendments and/or additional services or arrangements required by you (insurance and amendment charges). If the increase is in excess of 8%, then we may offer you an alternative package travel booking – you may accept this in replacement for your existing booking, in which case we will change your booking to that package travel booking, and, if the booking price for that package travel booking is lower, refund you the difference in the booking price. Alternatively, you may cancel your booking, in which case we shall refund to you the amount of the booking fee paid less any insurance and amendment charges. Should you wish to exercise these rights you must do so within 14 days of receiving our notification of the change in the booking price.


Should the price of your package travel booking go down due to the changes mentioned above, then any refund due will be paid to you less administrative costs incurred by us.


Other than to correct errors in late bookings, there will be no change made to the booking price of your package travel booking during the 20-day period before your departure.


5. Pricing of Packages

When you book travel arrangements with us, you must pay a minimum deposit of £200 per person unless your booking is made within 12 weeks of departure, whereby the full price of the travel arrangements will be payable at the time of booking.


We reserve the right to amend the price of unsold trips at any time and correct errors in the prices of confirmed trips. We also reserve the right to increase the price of confirmed trips solely to allow for increases which are a direct consequence of changes in:


The price of your confirmed holiday is subject at all times to changes in transport costs such as fuel, and any other airline cost changes which are part of our contracts with airlines (and their agents), operators and any other transport provider; and to changes in the currency exchange used to calculate your arrangements and to rates, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports any or all of which may result in a variation of your holiday price. We will absorb and you will not be charged for any increase equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges and/or additional services or travel arrangements. You will be charged for the amount over and above that, plus any applicable administration charges together with any amounts to cover agents’ commission. If this means that you have to pay an increase of more than 10% of the price of your confirmed travel arrangements (excluding any insurance premiums, amendment charges and/or additional services or travel arrangements), you will have the option of accepting a change to another holiday if we are able to offer one (if this is of equivalent or higher quality you will not have to pay more but if it is of lower quality you will be refunded the difference in price), or cancelling and receiving a full refund of all monies paid to us, except for any insurance premiums and any amendment charges and/or additional services or travel arrangements. Should you decide to cancel for this reason, you must exercise your right to do so within 14 days from the issue date printed on your final invoice. There will be no change made to the price of your confirmed holiday within 20 days of your departure nor will refunds be paid during this period. We will consider an appropriate refund of insurance premiums paid if you can show that you are unable to transfer or reuse your policy. Should the price of your holiday go down due to the changes mentioned above, by more than 2% of your confirmed holiday cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.


6. Changes by You

If you wish to change any part of your booking after our booking confirmation has been issued, you must inform us in writing as soon as possible. This must be done by the first named person on the booking.


Whilst we will do our best to assist, we cannot guarantee that we will be able to implement your requested change.


Where we can implement a request, all changes will be made subject to payment of an administration fee of £50 per person per change, as well as any applicable additional amounts due for the amended services. You should be aware that costs for changes are likely to be higher closer to the departure date.


Changes may not be made less than 4 weeks prior to departure, except as set out herein, unless we agree otherwise.


If you or any member of your party wishes to do so, that person(s) may transfer their place to someone else (introduced by you and satisfying all the conditions applicable to the arrangements) providing we are notified not less than 7 days before departure, and you meet all insurance and amendment charges (including those charged by the ultimate supplier(s) of your booking. For the avoidance of doubt, the transferee shall be bound by all contractual terms relating to the booking.


Where we are unable to implement the change and you do not wish to proceed with the original booking you may cancel the booking in which case the cancellation charges set out in clause 7 below will become payable.


Please note that certain bookings or parts of bookings may not be amended after our booking confirmation has been issued and any implementation of any change may require that booking or part thereof to be cancelled in its entirety and a new booking made. In such an event a cancellation charge of 100% may apply along with the booking price for the new booking.


7. If you cancel

If you wish to cancel your package travel booking you must notify us in writing. Your notice of cancellation will only be deemed given when received in writing by us at our offices (the cancellation date). We recommend that you use recorded delivery post and retain a copy.


Where you are cancelling your booking, subject always to the other provisions of these terms, you will have to pay the applicable cancellation charges shown below, calculated with reference to the total booking price payable, excluding insurance and amendment charges. In addition, you must pay any insurance and amendment charges, as no part of these may be cancelled.

Please note that certain arrangements, particularly flights, may not be amended after they have been confirmed and any alteration or cancellation could incur a cancellation charge of up to 100% of that part of the arrangements in addition to the charge above. Some bookings may also incur different cancellation charges as a result of the cancellation charges imposed by our suppliers. In that event, we shall have the right to increase our cancellation charges to cover our additional liability to these suppliers. Some accommodation providers may also require additional deposits, which will not be returned to you upon cancellation. If you wish further information, please enquire at the time of booking. Where the full deposit has not been paid at the time of cancellation you will be required to pay the remainder of the deposit. If the reason for your cancellation is covered under the terms of an insurance policy, you may be able to reclaim the cancellation charges. We will deduct the cancellation charges from any monies you have already paid to us. No refunds will be given for unused services.


8. If we change or cancel

It is unlikely that we will have to make any changes to your travel arrangements, but we do plan the arrangements many months in advance. Occasionally, we may have to make changes and we reserve the right to do so at any time. Most of these changes will be minor and we will advise you of them at the earliest possible date. We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. However, we will not cancel your travel arrangements less than 98 days before your departure date, except for reasons of force majeure or failure by you to pay the final balance.


Minor changes

Examples of “minor changes” include the following when made before departure:


i. Any change in the advertised identity of the carrier(s), flight timings, and/or aircraft type.

ii. A change of outward departure time or overall length of your holiday of twelve hours or less.

iii. A change of accommodation to another of the same standard or classification.


You do not have a right to cancel due to minor changes, and we do not offer compensation for minor changes.


Major changes


Occasionally we may have to make a major change to your confirmed arrangements. Examples of “major changes” include the following, when made before departure:


i. A change of hotel accommodation area for the whole or a significant part of your time away.

ii. A change of hotel accommodation to that of a lower standard or classification for the whole or a significant part of your time away.

iii. A change of outward departure time or overall length of your arrangements of twelve or more hours.

iv. A change of UK departure airport, as long as that change is not from one London airport to another London airport (London airports are Heathrow, Gatwick, Stansted, Luton, and London City’), or as long as that change is not from Glasgow to Edinburgh (including Glasgow Prestwick).


If we have to make a major change or cancel, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of:


i. accepting the changed booking;

ii. having a refund of all monies paid; or

iii. alternative arrangements of lower, equivalent, or superior quality from us, if available (we will refund any booking price difference if the alternative is of a lower value, but if the booking price is higher you will have to us the higher booking price).


You must notify us of your choice within 7 days of our offer, or within such shorter period we may reasonably require. If you fail to do so, you will be deemed to have accepted the changed booking.


If we make a major change or cancel, we will (subject to the exclusions noted below) also pay compensation as detailed below:

*A child invoiced at a reduced rate will be paid credit/compensation on a pro rata basis according to that reduced rate as compared to the adult rate.


The compensation that we offer does not exclude you from claiming more if you are entitled to do so under law. We may deduct from the compensation any amounts payable to us by you.


9. Exclusions from compensation

We will not pay you compensation in the following circumstances:


  1. In the event we are forced to make a change or cancel as a result of circumstances beyond our control. Such circumstances will usually include, but are not limited to, war, threat of war, airport closures, airspace closures (as well as other air traffic management decisions which may give rise to long or overnight delays or cancellations of one or more flights), epidemic, pandemic , other significant risks to human health such as the outbreak of a serious disease at the travel destination, natural or nuclear disaster, serious security problems such as terrorist activity, civil unrest or events arising out of political instability, industrial dispute or strikes, bad weather (actual or threatened), the presence of government advice against travel to a particular destination, significant building work taking place outside of your accommodation (such as resort development) or the inability of airline(s) to operate flights (including the loss or restriction of air traffic or transit rights or the right of airline(s) to enter any airspace.
  2. If we make a minor change;
  3. If we cancel as a result of your failure to make full payment on time;
  4. Where the change(s) or cancellation by us arises out of alterations to the confirmed booking requested by you; or
  5. If we cancel your arrangements because any minimum number of participants set out as a requirement in the booking confirmation has not been reached.


The above sets out the maximum extent of our liability for changes and cancellations and we regret we cannot meet any expenses or losses you may incur as a result of a change or cancellation. In the event of a change or cancellation, you will receive only the payments expressly set out in these terms. Please note: where accommodation with a higher price than the original accommodation is offered by us and accepted by you, the difference in price will be deducted from any compensation payable.


10. Difficulties during your booking

If you or any of your party have difficulties during your holiday, we shall (at no charge to you unless the difficulty has arisen due to your negligent or deliberate action or lack of action, or action or lack of action in breach of our contract with you) provide appropriate assistance including providing appropriate information on health services, local authorities and consular assistance.


If we become unable to provide a significant proportion of your holiday after you have departed, we will make suitable alternative arrangements for you at no extra charge and, if of a lesser value, compensate you for the difference. If we cannot make alternative arrangements to your reasonable satisfaction, we will, provide you with transport back to the place of departure and provide you with reasonable compensation reflecting the value of the part of your holiday which we did not provide.


If it is impossible to arrange your return from your holiday due to unavoidable circumstances, we will bear the cost of necessary accommodation, for an equivalent category of accommodation, for a maximum of three nights. This limit does not apply to persons with reduced mobility and any person accompanying them, pregnant women and unaccompanied minors, or persons in need of specific medical assistance, provided that you notified us of these needs at least 48 hours before the start of your holiday.


If you experience illness during your holiday you should report this to the hotel or our local representative (if there is one) or use the 24-hour telephone number printed on your booking confirmation. You should also consult a local doctor. If, on return to the UK, your symptoms are ongoing, you should make arrangements to visit your local GP.


A failure to take reasonable and sensible steps to mitigate or minimise the effect of any issues upon you or your holiday may affect your rights in the event of a subsequent dispute between you and us.


11.Our Responsibilities to you in respect of Package Holidays

  1. We will accept responsibility for the arrangements we agree to provide or arrange for you as an “organiser” under the Package Travel, Package Holidays and Package Tours Regulations 1992 as set out below. Subject to these booking conditions, if we or our suppliers perform or arrange your contracted holiday arrangements negligently, taking into consideration all relevant factors (for example following the complaints procedure as described in these conditions and the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your holiday), we will pay you reasonable compensation. Please note that it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.
  2. We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost, or other claim of any description if it results from:-
  3. the act(s) and/or omission(s) of the person(s) affected;
  4. the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
  5. unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or
  6. an event which either we or suppliers could not, even with all due care, have foreseen or forestalled.
  7. We limit the amount of compensation we may have to pay you if we are found liable under this clause:
  8. for loss of and/or damage to any luggage or personal possessions and money, the maximum amount we will have to pay you in respect of these claims is £25 per person in total because you are assumed to have adequate insurance in place to cover any losses of this kind;
  9. for claims not falling under 3(i) above and which don’t involve injury, illness or death, the maximum amount we will have to pay you in respect of these claims is twice the price paid by or on behalf of the person(s) affected in total. This maximum amount will only be payable where everything has gone wrong, and you or your party has not received any benefit at all from your booking.
  10. for claims in respect of international travel by air and sea, or any stay in a hotel, the extent of our liability will in all cases be limited as if we were carriers under the appropriate Conventions, which include The Warsaw/Montreal Convention (international travel by air); The Athens Convention (with respect to sea travel); The Berne/Cotif Convention (with respect to rail travel) and The Paris Convention (with respect to hotel arrangements). You can ask for copies of these Conventions from our offices. Please contact us. In addition, you agree that the operating carrier or transport company's own 'Conditions of Carriage' will apply to you on that journey. When arranging transportation for you, we rely on the terms and conditions contained within these international conventions and those 'Conditions of Carriage'. You acknowledge that all of the terms and conditions contained in those 'Conditions of Carriage' form part of with us, as well as with the transport company and that those 'Conditions of Carriage' shall be deemed to be included by reference into this contract.
  11. In any circumstances in which a carrier is liable to you by virtue of the Denied Boarding Regulation 2004, any liability we may have to you under our contract with you, arising out of the same facts, is limited to the remedies provided under the Regulation as if (for this purpose only) we were a carrier. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the transport provider or hotelier for the complaint or claim in question.
  12. It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves and our supplier(s) strictly in accordance with the complaint’s procedure set out in these conditions. Where any payment is made, the person(s) receiving it (and their parent or guardian if under 18 years) must also assign to ourselves or our insurers any rights they may have to pursue any third party and must provide ourselves and our insurers with all assistance we may reasonably require.
  13. Please note, we cannot accept any liability for any damage, loss or expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you.
  14. We will not accept responsibility for services or facilities which do not form part of our agreement or where they are not advertised by us. For example, any excursion you book whilst away, or any service or facility which your hotel or any other supplier agrees to provide for you.
  15. We will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where we aren’t able do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).


12. Delays, Missed Transport Arrangements, and other Travel Information

If you or any member of your party misses your flight or other transport arrangement, it is cancelled or you are subject to a delay of over 3 hours for any reason, you must contact us, and the airline or other transport supplier concerned immediately.


The Package Travel Regulations provide that in the event that you experience difficulties, we will provide you with prompt assistance. Where you experience a delay which is not owing to any failure by us, our employees or sub-contractors, this prompt assistance is likely to extend to providing help in locating refreshments, accommodation and communications but not paying for them. Any airline or other transport supplier may however pay for or provide refreshments and/or appropriate accommodation and you should make a claim directly to them. Subject to the other terms of these conditions, we will not be liable for any costs, fees, or charges you incur in the above circumstances if you fail to obtain our prior authorisation before making your own travel arrangements.
